Legal obstacles of EGTCs. Analysis and recommendations. (Legal Accessibility: Third milestone)

One of the sub-projects of the third milestone of the Legal accessibility project included the review of experiences regarding EGTCs of Hungarian interest and legal obstacles. Besides conducting a survey and a series of interviews with the EGTCs along the Hungarian border, desk research work was carried out as well.

As a result of the project, in 2018 a study was conducted in English, which was sent by CESCI to the EU institutions involved in EGTC-policy. The study summarises the activities related to this sub-project.

The initial objective of the document was to systematise the experiences of the Hungarian EGTCs regarding the incorrect and exemplary application of the regulation in order to review the planned EGTC regulation in connection with the EU budget planning process launched in 2018, and to make proposals to amend the regulation in a way which can exclude incorrect applications and promote exemplary models in the entire EU territory. The study evaluates the relevant European and Hungarian legal environment, and systematise the operational experiences of the Hungarian EGTCs, including establishment and registering procedures, programming, tendering, information about participating in and managing of ETC programmes, as well as the legal-administrative obstacles. Last but not least, the study details the proposals arising in order to ensure accessibility.
